Terms of Service - evernook

1. Acceptance of Terms

By downloading, installing, or using evernook ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App. The App is provided by Swiftmill UG (haftungsbeschrankt) ("we", "us", or "our").

2. Apple Standard EULA

The App is licensed to you under Apple's Standard End User License Agreement (EULA). You can review Apple's Standard EULA at: Apple Standard EULA

In the event of any conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall prevail for matters related to the App Store distribution.

3. Description of Service

evernook is a focus and productivity app that provides:

Animated study companion characters
Lofi music and ambient soundscapes
Focus timer with Pomodoro technique support
App blocking functionality during focus sessions
Room and character customization options
Progress tracking and achievements

4. Subscriptions and Payments

Some features of evernook require a paid subscription. By purchasing a subscription:

Payment will be charged to your Apple ID account at confirmation of purchase
Subscription automatically renews unless canceled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel your subscriptions in your App Store account settings
Any unused portion of a free trial period will be forfeited when purchasing a subscription

5. User Conduct

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse engineer, decompile, or disassemble the App
Remove or alter any proprietary notices or labels on the App
Use the App in any way that could damage, disable, or impair the service
Share your account credentials with others

6. Intellectual Property

All content in the App, including but not limited to artwork, animations, music, sounds, text, and software, is owned by Swiftmill UG or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7. Music and Audio Content

The lofi music and ambient sounds provided in evernook are licensed for use within the App only. You may not record, extract, or redistribute any audio content from the App. All music is provided by independent artists and remains their intellectual property.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFTMILL UG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Darmstadt, Germany.
